Telehealth Abortions Limited
The most common method of abortion in the U.S., an at-home two-pill regimen of mifepristone and misoprostol, is temporarily unavailable through the mail.
On Friday, an appeals court paused an FDA rule allowing doctors to send mifepristone by mail without first seeing their patients in person. The unanimous panel of Republican-appointed judges said Louisiana, which brought the suit, was likely to win its arguments that:
- The FDA’s rationale for allowing telehealth mifepristone prescriptions was based on flawed data that doesn’t track women’s nonfatal side effects
- The Bayou State (which bans medical abortions) would suffer “irreparable harm” if the FDA’s policy remained in place while LA continued litigation
Louisiana’s AG celebrated that the “nightmare is over.” A mifepristone manufacturer said the ruling will cause “chaos” and asked the U.S. Supreme Court to restore nationwide mail-order access.
